The plenary discussion will take place on December 2nd
Appeals on the same subject have also been deposited by the Bar Association of Athens, Kalamata, Thessaloniki, Volos, Heraklion, Syros and Kavala.
The Regional Union of Municipalities of the Peloponnese, the Chamber of Kavala, the “Greek Taxpayers” association and two lawyers have also appealed. Appeals will be discussed in the StE plenary on December 2nd, 2011, with State Adviser Evangelia Nika as rapporteur.
All seek to annul the decision of the Deputy Minister of Finance (issued under the authority of Law 4021/2011), which outlines the process of recovery, temporary special duty.
The main argument is that the 'hike' is not a specific charge, but a new tax, which is contrary to the Constitution and the European Convention on Human Rights (ECHR) which protects the property.
In the ADEDY application, it argues that it has as an interest to challenge the StE to issue a decree, and its purpose is to defend the economic interests of its members.
The same argument in its application, has put forth the Municipality of Pilea - Chortiati, who also says that the imposition of the fee is limiting the property of the inhabitants of the municipality.
